What is a Section 27 Dismissal?


Under Section 27 (Dismissal) of the BC Human Rights Code, an employer can apply to have a complaint dismissed without a hearing. The most common grounds include the complaint having no reasonable prospect of success, the Tribunal lacking jurisdiction, or if the complaint was filed in bad faith. This application can only be submitted after the Tribunal has reviewed the disclosure documents AND after the Tribunal gives permission.
