How can I stop a BCHRT complaint?

Under Section 27 of the BC Human Rights Code, an employer can apply to dismiss a portion or the whole complaint without a hearing at the BCHRT. The most common grounds include the complaint having no reasonable prospect of success, the Tribunal lacking jurisdiction, or if the complaint was filed in bad faith. An employer can apply for dismissal by completing and submitting Form 7.2 "Dismissal Application". This application is a critical early-stage defense to minimize legal exposure. While there are exceptions, in general, you must complete document disclosure before you apply to dismiss a complaint.
